These terms apply to the use of this website and, where indicated, to services provided by Active Marketing. Where we have signed a separate written agreement or accepted proposal with you, that document takes precedence over these terms to the extent of any conflict.

You may use this website for lawful purposes only. You may not attempt to gain unauthorised access to the site or any connected system, introduce malicious code, or use automated means to extract content at a scale that affects the site for others.

We take care to keep the information on this site accurate and current, but it is provided for general information. Case study figures, performance metrics and examples describe past results for specific clients under specific conditions. They are not a prediction or guarantee of results for your business.

Prices shown on this website are indicative starting points and are not an offer. Final scope and pricing are confirmed in writing before any work begins. Quotations are valid for 30 days unless stated otherwise. All prices are in South African Rand and exclude VAT unless expressly stated.

Where we manage advertising campaigns, the platform advertising budget is paid by you directly to the platform, such as Google or Meta. Our fees cover strategy, setup, management, optimisation and reporting, and are separate from advertising spend.

Retainer fees are invoiced monthly in advance unless agreed otherwise. Project work is invoiced according to the milestones set out in the accepted proposal. Invoices are payable within the period stated on the invoice. We may suspend work on overdue accounts after giving reasonable notice.

Delivery depends on your timely input. You agree to provide the content, access, approvals and feedback we reasonably require, and to ensure that any material you supply does not infringe the rights of a third party. Delays in providing these may affect agreed timelines.

Monthly retainers may be cancelled by either party on one calendar month written notice. Fees for the notice period remain payable. Project work already performed is payable on cancellation, and any third-party costs already committed are for your account.

On full payment, ownership of final deliverables created specifically for you transfers to you. We retain ownership of our underlying tools, templates, processes and know-how, and of any working files, concepts or drafts not selected. We may reference the work and display it in our portfolio unless you ask us in writing not to.

Where we work inside advertising, analytics or hosting accounts, those accounts remain yours. You retain ownership of the accounts, their history and the data in them, both during and after our engagement.

To the extent permitted by law, our total liability arising from our services is limited to the fees paid by you for the services giving rise to the claim in the three months preceding it. We are not liable for indirect or consequential loss, including loss of profit, revenue or anticipated savings. Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act where it applies.

Our services depend on platforms operated by third parties, including Google, Meta and hosting providers. We are not responsible for changes to their policies, pricing, algorithms or availability, or for account suspensions imposed by them.

Each party agrees to keep the other party confidential business information confidential and to use it only for the purposes of the engagement.

These terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
